甲方:

甲、乙雙方依據《民法典》以及有關法律、法規規定,遵循平等自願、

協商一致、誠實信用的原則,簽訂本契約。

一、契約期限:

甲、乙雙方約定按有固定期限的勞動契約自_____年____月___日起至_____年____月___日日止。並約定試用期自_____年____月___日起至_____年____月___日止。

二、工作內容:

乙方同意根據甲方要求,經過協商,從事營業工作。甲方根據工作需要,按照合理誠信原則,可依法變動乙方的工作崗位。

甲方安排乙方所從事的工作內容及要求,應當符合國家法律法規規定的勞動基準和甲方依法制訂的並已公示的規章制度。乙方應當按照甲方安排的工作內容及要求履行勞動義務。

三、工作時間和休息休假:

甲、乙雙方經協商一致,確認工作時間執行以下條款。

1、標準工時工作制。、綜合計算工時工作制。、不定時工作制。

甲方嚴格遵守法定的工作時間,保證乙方的休息與身心健康,甲方確因工作需要安排乙方加班加點的,應按照法律、法規規定安排補休或支付加班加點工資。

四、勞動報酬:

甲方應當每月至少一次以貨幣形式支付乙方工資,不得剋扣或者無故拖欠乙方的工資。乙

方在法定工作時間或依法簽訂勞動契約約定的工作時間內提供了正常勞動,甲方向乙方支付的工資不得低於當地最低工資標準。

甲方承諾每月23日為發薪日。

甲乙雙方協商約定月基本工資

雙方約定加班加點工資計發基數按月基本工資為標準結算。

五、社會保險:

甲、乙雙方嚴格按照國家及地方有關社保方面的規定,參加社會保險,按時繳納各項社會

保險費。其中,依法應由乙方繳納的部分,由乙方承擔。

六、勞動保護、勞動條件和職業病危害防護:

甲方對可能產生職業病危害的崗位,應當向乙方履行如實告知的義務,並對乙方進行勞動安全衛生教育,防止勞動過程中的傷亡事故,減少職業病危害。

甲方按照國家關於女職工、未成年工的特殊保護規定,對乙方提供保護。

七、勞動契約終止、解除的條件和不得解除勞動契約的規定:

有下列情形之一者,甲方可以解除勞動契約:

1、乙方在試用期間被證明不符合錄用條件的;

2、乙方患病或非因公負傷,醫療期滿後不能從事原工作的,也不能從事由甲方另行安排工作的;

3、乙方嚴重違反勞動紀律、規章制度的;

4、乙方失職,營私舞弊,對甲方造成重大損害或給甲方造成5000元以上經濟損失的;

5、乙方不能勝任工作,經過培訓或者調整工作崗位後仍不能勝任工作的;

6、乙方泄露甲方的商業機密給甲方造成損害的;

7、乙方兼任其他公司工作的;

8、乙方提供不真實人事資料的;

9、勞動契約訂立時所依據的客觀情況發生重大變化,致使本契約無法履行,經雙方協商未能就變更契約達成協定的;

10、其他根據《民法典》及相關法律,行政法規的規定可解除的。

甲方有下列情形之一的,乙方可以解除勞動契約:

未按照勞動契約約定提供勞動保護或者勞動條件的;

甲方以暴力、威脅或非法限制人身自由強迫勞動的;

乙方提前三十日以書面形式提出辭職,移交正常工作並經甲方同意的。

有下列情形之一者,勞動契約終止:

勞動契約期滿的;

乙方開始依法享受基本養老保險待遇的;

乙方死亡,或者被人民法院宣告死亡或者宣告失蹤的。

甲方宣布解散的,或因門店經營不善、租賃契約解除、加盟商撤資、閉店或不可預定的天災、事故導致門店無法繼續營業的;

有下列情形之一的,甲方不得終止或解除契約:

職工因工負傷或患職業病在規定的醫療期間的;

法律、法規規定的其他情形。

甲、乙任何一方提出解除契約,應提前三十天以書面形式通知對方。

八、雙方協商一致,約定下列條款:

由甲方出資對乙方進行專業技術培訓,並要求乙方履行服務期的,應當事前徵得乙方同意,明確雙方權利義務。

未約定的按民法典的相關規定執行。

九、爭議處理:

甲、乙雙方因履行本契約發生勞動爭議,可以協商解決。不願協商或者協商不成的,可以

向本單位勞動爭議調解委員會申請調解;調解不成的,可以向勞動爭議仲裁委員會申請仲裁。甲、乙雙方也可以直接向勞動爭議仲裁委員會申請仲裁。

十、其它事項:

勞動契約期內,乙方戶籍所在地址、現居住地址、聯繫方式等發生變化,應當及時告知甲方後的三日內書面告之甲方。否則,由此造成的法律後果由乙方承擔。

本契約未盡事宜,均按國家有關規定執行,國家沒有規定的,通過雙方平等協商解決。

本契約不得代簽和塗改。

甲、乙雙方另行簽訂的《補充協定》作為本契約的附屬檔案,與本契約具有同等效力。

本契約附屬檔案包括:《梅爾卡蘭奴門店員工行為管理規定》

十一、本契約一式兩份,甲乙雙方各執一份,經雙方簽字,蓋章後生效。

根據《中華人民共和國民法典》的規定,甲、乙雙方在平等自願、協商一致的基礎上,訂立本僱傭契約,共同遵守。

一、乙方於每周一至周五負責烹製甲方工作期間的一伙食,一日兩餐。

二、本僱傭契約期限為_________年,其中試用期為_________個月。試用期內,甲方負責採購一伙食原料,並獨立核算一伙食成本,試用期滿後,由乙方負責採購一伙食原料,但一伙食收費標準必須遵照甲方核定的成本價標準。

七、乙方應當注意上下班途中自身的人身安全,若發生意外事故,乙方自行承擔責任,甲方概不負責。
