事緣:
(一)_____(下稱本人)於200__年__月__日與_____(下稱"發展商")簽訂《商品房買賣契約》(下稱該買賣契約)以人民幣_____元及接該契約之條件向發展商預購座落於_____之房產。
(二)本人為履行該契約中所列之條件及核付應付之樓價向銀行借款人民幣_____元整,200___年___月___日與銀行簽訂了《房屋按揭貸款契約》(下稱該貸款契約)、《房屋按揭貸款抵押契約》(下稱該抵押契約)上述契約編號:___。本人保證按時還款,並以買賣契約項下本人應有之全部權益及該貸款契約項下的房產(包括預售階段房產)及其有關權益(下稱)〔抵押物1〕抵押給銀行,賦予銀行第一優先抵押權,並在銀行開設活期存摺,帳號_____(下稱該帳號),對貸款契約中所有應付之款項均從此帳號照付。
(三)為保證受託人權益及委託人之轉取款方便,本人同意簽訂此委託書,全權委託受託人處理該帳戶中有關應付款項的轉取。
本人保證:
1、同意銀行以無折(卡)支取方式在授權扣款帳戶中按貸款契約規定扣取貸款金額入發展商( )的帳戶,授權銀行在該帳戶中代扣印花稅(金額為:貸款金額的0.05‰),以及扣取銀行每月供款和過期罰息。
2、若因扣款帳戶餘額不足或本人其他原因導致銀行無法按時足額扣款,本人承擔由此產生的違約責任。違約後第一筆還款由本人在 三 日內到銀行指定的網點辦理。
3、若扣款帳戶發生掛失、練結、結清,或本人需要變更扣款帳戶,本人應到銀行辦理變更手續。在變更手續生效前,若扣款帳戶已無法足額抵扣款,本人應到銀行指定的網點辦理還款。
本人確認並聲明此項委託是不可撤回的,除非得到受託人的書面同意。本委託書的訂立、解釋及爭議的解決將適用中華人民共和國法律,受中華人民共和國法律保障。
