17 其他事項 other items
17.1 棄權和變更
17.1 abstention and alteration
此協定中的規定的權利不得:
棄權,除非由棄權方以書面形式提出棄權;或
(b) 變更,除非經雙方同意並由書面方式確定.
the rights provided in this agreement may not:
(a) be abstained, unless a written application for abstention be given; or
(b) be changed, unless be confirmed in writing through mutual agreement.
17.2 矛盾
當協定正文與各附屬檔案或附錄發生矛盾時,除非在本協定中另有規定,否則以協定正文為準.
17.2 contradictions
if there is a conflict between the body of agreement with the annex or appendix, unless otherwise agreed in this agreement, the body of this agreement prevails.
17.3 全部協定
本協定包含了雙方對協定主題的全部諒解和合意,先前關於該主題任何形式的協定,陳述,諒解,協商(包括口頭和書面的)將不再具有效力.
17.3 full agreements
this agreement contains full understanding and acceptability on the subject of two parties, any former agreement, statement, understanding, consultation (including oral and written) on this subject in any form will no longer be effective.
18 安全與消防 safety and fireproof
18.1 乙方應嚴格遵守國家,行業關於物流操作安全的各類安全法律,法規及甲方在附錄b,附錄c中詳述的甲方之各類規定,幾者間取其標準較高者為準.
18.1 party b shall strictly abide by all national and industrial security laws and regulations about logistics operation security and party a's regulations detailed in appendix b and appendix c, the highest one among those standards prevails.
18.2 乙方應嚴格遵守國家關於倉儲消防安全的各項法律,法規,須確保倉庫已通過消防部門的審查,驗收,符合一切可投入使用的標準.
18.2 party b shall strictly abide by all national laws and regulations about warehouse fire safety, and must ensure that the warehouse has already passed the examination and inspection of fire department and is conformity with all standards for put into operation.
18.3 乙方各類違反安全,消防法律,法規,規定的行為,無論是否已造成甲方的實際損失或國家相關機構是否已對其進行了處罰,除乙方須對甲方作出相應賠償外,甲方有權根據本協定的相關內容另對乙方進行處罰.
18.3 for any act of party b that violates security and fire laws or regulations, whether it has resulted actual loss for party a or has been punished by relevant state organizations, except the necessary compensation must be made by party b to party a, party a has right to give otherwise punishment to party b according to the content involved in this agreement.
